The undersigned hereby acknowledge that he/she has read the rules of the Photo Finish Contest and fully understands them. Further, the undersigned acknowledges and understands that Pearl intends to use and/or publish photographs submitted by the participants in the contest, which may or may not include photographs submitted by the undersigned, for marketing promotional or other legitimate business purposes; which purposes may include publication on the Oyster Bay Beach Resort website as well as publication in certain sales, marketing and promotional material for the Resort. The undersigned specifically authorizes and agrees that photographs for sales, marketing, promotional or any other legitimate business purpose. Further, the undersigned acknowledges and agrees that the undersigned is not entitled to any compensation or remuneration of any kind in the event that Pearl elects to use any such photographs for the aforementioned purposes. The undersigned hereby unconditionally releases and discharges Pearl Development, N.V., Iron Shore Management, N.V. and their respective managing directors, shareholders, employees, directors, independent contractors and agents from any and all liabilities, duties and/or obligations to the undersigned, now existing or hereafter arising, under, pursuant to or in connection with the Owner's Appreciation Week Photo Context.
